Terms & Conditions

1.1 Scope and operator

These Terms & Conditions govern use of the you&hue website and purchases made through it. The Shipping & Delivery and Returns & Cancellations sections form part of these terms. The Privacy Policy explains how personal information is handled.

The website and the you&hue brand are operated by Polyframe Art Technology (Hong Kong) Company Limited, a limited liability company incorporated in Hong Kong (the “Company”, “we”, “us” or “our”).

All orders and payments, including custom orders agreed by email, are completed through Shopify Checkout. Email enquiries, quotations and artwork approvals do not themselves take payment. Selecting a product or viewing a local photograph preview does not, by itself, place an order or submit that photograph.

1.2 Eligibility and information supplied

To place an order, you must have legal capacity to enter into a contract under applicable law. Please provide accurate contact, delivery and order information. A person ordering on behalf of someone else must have authority to provide the relevant information and content.

1.3 Orders, prices and payment

Product prices and the payment currency are shown before payment. Available destinations, shipping charges and any taxes collected at checkout will be displayed before an order is placed. Product prices exclude taxes and import duties. For United States and Canada deliveries, applicable duties and import taxes are calculated and added separately at checkout. For other international destinations, the recipient is responsible for applicable import charges collected by the carrier before delivery. Delivery and customs arrangements are addressed in Shipping & Delivery.

Orders require confirmation of payment and an available delivery destination. An order may be paid before reference photographs are supplied; preparation of the artwork preview requires all necessary, usable photographs. If a material pricing or product-information error is identified, we will contact you before proceeding and offer the corrected details or cancellation with a refund. We will not increase an accepted order’s price without your agreement.

1.4 Personalization and product specifications

Our sports artworks use compositions, colour palettes and painting styles designed by you&hue. Personalization is based on the photographs supplied within the selected design. Changes to the template, background, frame or composition are available only where expressly offered or agreed before approval. Small text additions are subject to agreement.

The finished product is a 100% hand-painted oil painting, supplied with its coordinating frame and hanging hardware, ready to hang. The artwork measures 16 × 20 inches (40.6 × 50.8 cm), excluding the frame. Frame specifications are those stated in the product description or otherwise agreed before payment; the artwork size does not include the outer frame.

1.5 Paint Your Photo

Paint Your Photo is a separate enquiry-first service using your own scene and composition in the you&hue painting style. The displayed starting price is for a standard 16 × 20 inch artwork with a coordinating frame. Comments describing your requirements are required. Requested additions, changes or special sizes may affect the final price. We confirm the scope, price and any pre-production preview before you place an order or painting begins. All custom orders and payments are completed through Shopify Checkout.

We share progress during painting, check the work with you before completion, and obtain approval of the finished painting before dispatch. The same-day/next-day digital preview timing for our designed sports collections does not apply to this service; the quote confirms its timing. The cancellation and consumer-rights provisions in Returns & Cancellations remain applicable, with any custom production approval identified before it is given.

1.6 Reference photos after payment

You can upload reference photographs on the product page before checkout. If photographs are missing or incomplete after payment, we will email the address used for your order and ask you to reply with the photographs attached. Include your order number when contacting us separately. We review emailed photographs manually; selecting or emailing a photograph does not approve a painting or start production. Preview timing begins only once payment and all required, usable reference photographs have been received.

1.7 Digital preview and approval

For our designed sports collections, after payment and all required, usable reference photographs have been received, we will email a digital artwork preview. If these requirements are completed during customer care hours, 9am–6pm HKT every day, the preview is provided that day; otherwise, it is provided the next day.

Please review the preview and confirm approval by replying to the order email. Production begins only after final approval. Cancellation and one reference-photo replacement before approval are addressed in Returns & Cancellations. Digital previews are provided for approval and are not printable production files.

1.8 Hand-painted characteristics and visual representations

Each painting is made by hand. Minor variations in brushwork, texture and colour are natural characteristics of this process. Screen settings, lighting and styled room images may also affect the appearance of colour and scale.

These characteristics do not excuse a fault, a materially incorrect personalization, or failure to supply the product as agreed. Product images must be read together with the written specifications and the approved artwork preview. Styled room settings are illustrative and do not establish the artwork’s dimensions.

1.9 Reference photographs and limited permission

You must own, or have permission to use, the photographs and other content supplied for your order. This includes relevant copyright permissions and permission relating to identifiable people, including parental or guardian permission where appropriate. Please do not submit content that infringes another person’s rights or is unlawful.

You retain any rights you hold in the material supplied. You give us permission only to receive, store, reproduce and adapt that material as necessary to prepare the preview, produce and deliver your artwork, and provide related customer care. Necessary access may be given to personnel and service providers performing these tasks. This permission does not authorize unrelated advertising, resale of your photographs or public display of your photos or personalized artwork. Public display requires separate permission.

1.10 Intellectual property and permitted website use

Brand names, original template designs and website content belong to us or their respective rights holders. Purchasing a physical artwork does not, by itself, transfer copyright or a right to commercially reproduce its design. This does not affect rights you already hold in your own photographs or other material.

You may use the website for lawful browsing and shopping. You must not interfere with its operation, introduce malicious software, impersonate another person or copy protected website materials for unauthorized commercial use. Contact us if you believe website material infringes your rights.

1.11 Promotions and discount codes

A customer may receive a personal, single-use code for 10% off a subsequent order by giving separate permission for an artwork feature, or by publishing a social-media photo post that tags you&hue. Customers may send the post or permission by replying to their order email for manual verification and issue of the code.

A tag does not authorize reposting. Feature permission is optional and is not a condition of purchase. The reward does not depend on a positive review. Any eligibility, expiry or redemption conditions will be stated with the code before use. A printed gift message card is not a stored-value gift card.

1.12 Shopify commerce and privacy services

Shopify powers checkout, order management and related commerce services. Shopify and its service providers process the information needed for those services, and information may be processed in other countries. Shopify’s applicable terms, payment rules, privacy notices and customer choices continue to apply. See our Privacy Policy, Shopify Consumer Privacy Policy and Shopify Privacy Portal for Shopify’s processing and applicable privacy choices.

1.13 Customer rights and service issues

The remedies for cancellation, damage, faults and nonconformity are set out in Returns & Cancellations. Nothing in these terms excludes or restricts consumer rights, remedies or liabilities that cannot lawfully be excluded or restricted. Any applicable mandatory consumer protections take priority over conflicting provisions.

Please use Contact Us or reply to your order email to raise an order issue. Email us any time. We reply to every email within 24 hours, every day.

1.14 Business contact information

1.15 Governing law and disputes

These terms are governed by the laws of Hong Kong, subject to any mandatory protections applicable to the customer. The courts of Hong Kong have non-exclusive jurisdiction, without depriving a customer of any right to bring proceedings elsewhere under applicable mandatory law.

1.16 Changes and interpretation

The version in effect when an order is placed applies to that order unless a change is required by law or separately agreed with the customer. Updated website terms will show their revision date. Material changes will be communicated where required. If a provision is invalid or unenforceable, the remaining provisions continue to apply to the extent permitted by law.

Shipping & Delivery

2.1 Production period

Production begins after final approval of the digital artwork preview. Allow 5–7 business days to hand-paint and prepare the framed artwork. Time spent obtaining usable photographs or awaiting customer approval is additional to the production period.

2.2 Estimated transit times

Estimated transit times after dispatch are 8–12 business days for international standard shipping and 1–2 business days for Hong Kong. Express shipping to the United States and Canada has an estimated transit time of 2–3 business days.

Each painting is made to order. Production takes 5–7 business days after approval of your final preview and is additional to transit time. Time spent obtaining usable photographs or awaiting approval is also additional. Express shipping does not shorten production time.

Transit times are estimates and may be affected by customs processing, public holidays, carrier delays and seasonal demand. They are not a guarantee of delivery by a holiday or other specific date. Applicable rights concerning delay or non-delivery remain unaffected.

2.3 Destinations, delivery options and shipping charges

Standard shipping is complimentary to our available shipping destinations during our October–December 2026 holiday promotion, from launch through 31 December 2026. There is no minimum order value or quantity. Free shipping applies to standard delivery charges only; applicable duties and taxes are not included in this offer.

Hong Kong has one complimentary standard delivery option. Express shipping is available for USD 55 per order to the United States and CAD 78 per order to Canada, rather than per painting. Other available international destinations have standard shipping only. Available destinations, delivery options and charges are shown at checkout before payment.

We accept delivery addresses only where our shipping service is available. The available destinations are those selectable at checkout; we do not currently serve every country or territory worldwide. Availability can vary by destination and address.

2.4 Taxes and import duties

Product prices exclude taxes and import duties. For shipments to the United States and Canada, applicable duties and import taxes are calculated and collected separately at checkout. We arrange tax-prepaid delivery and settle the applicable import charges with the carrier. Checkout amounts are estimates, and final customs assessments may differ.

For other international destinations, we do not precollect import duties or import taxes at checkout. The carrier may contact the recipient for payment before delivery. Applicable carrier clearance, brokerage and disbursement fees for these shipments are also the recipient’s responsibility. Any separate sales tax that we are required to collect is shown at checkout; paying it does not necessarily cover import charges. Free standard shipping covers delivery charges only, not these import charges or fees.

For United States and Canada tax-prepaid shipments, carrier clearance, brokerage or disbursement fees not collected at checkout are handled as our fulfilment costs under this promotion. These carrier fees are separate from government duties and taxes.

If a carrier requests payment for duties or import taxes already collected at checkout, please contact us before paying so we can investigate.

2.5 Delivery details and gifts

Please check the recipient’s name, delivery address and contact details before placing an order, and notify us of an error as soon as possible. Address changes after dispatch may depend on the carrier.

Gift orders may be sent directly to the recipient and include a printed personal message card. Prices are omitted from the gift presentation. Legally required customs documentation may need to state the shipment’s value.

2.6 Loss or damage during delivery

Contact us with the order number if a parcel is delayed, missing or damaged. A parcel confirmed lost by the carrier will be replaced free of charge. Transit damage is addressed in Returns & Cancellations, including free remaking of a damaged painting without requiring its return.

Returns & Cancellations

3.1 Cancellation or photo replacement before approval

You may cancel an order for a refund at any time before approving the final artwork preview, including after a preview has been supplied. You may alternatively replace the reference photographs once before final approval. Contact customer care or reply to the order email to request either option.

3.2 Change-of-mind requests after approval

Final approval starts production of an artwork made specifically for the customer. Change-of-mind cancellations, returns and exchanges are not accepted after approval, including after delivery. This restriction does not apply to rights or remedies for damage, faults or failure to supply the product as agreed, or to any right that cannot be excluded under applicable law.

3.3 Painting or frame damaged in transit

For a painting damaged in transit, we will remake and resend it free of charge. You do not need to return the damaged painting. For frame damage, we will arrange a replacement frame or agree on a local reframing service at our cost.

Please provide the order number and clear photographs of the damage, packaging and shipping label. Retain the packaging while the claim is reviewed where practicable. These steps help us investigate; they do not remove any applicable statutory remedy.

3.4 Faults, quality issues or incorrect orders

If your artwork is faulty or materially differs from what was agreed, contact us with the order number and photographs showing the issue. We will work with you to provide an appropriate remedy. If the issue cannot be resolved, we will arrange a refund. This procedure does not limit any applicable right to repair, replacement, price reduction or refund.

3.5 Refund method and processing

Refunds are returned to the original payment method. Following processing, a refund may take up to 10 business days to appear, depending on the bank or payment provider. Store credit is an alternative only if the customer chooses it; it is not compulsory. Mandatory refund deadlines and rights under applicable law remain unaffected.

We may update this Privacy Policy from time to time, including to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the revised Privacy Policy on this website, update the "Last updated" date and provide notice as required by applicable law.

4.15 you&hue reference photographs and service providers

For personalized artworks and Paint Your Photo enquiries, we also receive reference photographs, your instructions and related correspondence. Cloudflare provides our storefront hosting and private uploaded-photo storage. Resend delivers website service emails. Photos sent by replying to our emails are received in our Gmail mailbox and reviewed manually. Shopify powers checkout and order administration; payment information is handled through Shopify and its payment providers.

You must have permission to supply photographs of other people and any necessary parental or guardian permission. Access to reference photographs is limited to personnel and providers who need them to assess your enquiry, prepare previews, paint and fulfil your artwork, or provide aftercare. Customer reference photographs are not public website media and are not automatically authorized for our advertising, public display or sale. We obtain separate permission before featuring a customer’s photos or personalized artwork. These specific photo restrictions do not replace Shopify’s separate data processing and privacy choices described above.

Reference photographs are retained only as long as necessary for the enquiry, order, aftercare, a service issue or an applicable legal obligation, and are then removed under our retention process. Order, payment and accounting records may have separate legal retention requirements. Contact hello@youandhueart.com for a photo retention or deletion request.

4.16 Storefront preferences and privacy choices

The storefront uses essential browser storage and secure cookies for shopping selections, photo-upload security and related service functions. An explicit delivery-country choice is remembered in local storage. Without a saved choice, approximate IP-based country detection selects an available region and currency; we do not request precise device location.

Shopify’s applicable privacy, advertising, consent and opt-out rules continue to apply to its services. Use the Shopify Privacy Portal for Shopify privacy choices and requests. For requests concerning information handled by you&hue, email hello@youandhueart.com. This policy does not treat an order or a service email as consent for promotional emails. We reply to every email within 24 hours, every day.

For enquiries concerning these policies, please use Contact Us.
